Alternative dispute resolution is either where the parties agree to have a neutral mediator help them reach a mutually satisfactory settlement of their dispute, or where they agree to have a neutral arbitrator decide the matter rather than going to the expense of trial.
Mediation is a confidential non-binding procedure controlled by the parties. A party to a mediation cannot be forced to accept an outcome that he or she does not like. The purpose is to attempt to settle the case to avoid further litigation costs and the uncertainties inherent with trial. Unlike an arbitrator or a judge, the mediator is not a decision-maker. The mediator's role is rather to assist the parties in reaching a settlement of the dispute. In an arbitration the outcome of a case is determined by the arbitrator based on the evidence and the law, and is often a more efficient and cost effective alternative to trial.
Because mediation is non-binding and confidential, it involves minimal risk for the parties and generates significant benefits. One could say that even when a settlement is not achieved, mediation never fails, as it causes the parties to define the facts and issues of the dispute, thus in any event preparing the ground for subsequent arbitration or court proceedings.
